In Canada, the Personal Information Protection and Electronic Documents Act (PIPEDA) governs how businesses (large and small) must to handle, store, send and receive electronic information that contains personal information, including online fax service. If PIPEDA is a new term to someone and they handle any type of personal information (of other people), then they need to understand how this impacts them before selecting an email fax service or internet fax service.

Online Fax Service: Canada and USA Not the Same

In the wake of the events of September 11, 2001, The United States implemented the US Patriot Act, which briefly, allows authorities to force a company to disclose file records containing private information while also forcing the company to keep the disclosure secret. In order words, a company with physical operations in the USA can be forced to hand over an individual's private information and not tell them about it. In Canada, businesses are forced to guarantee the protection of individual privacy, to only use that personal information of consented purposes and once no longer needed, are required to destroy it.

The differences in privacy protection within Canada verses The United States (or any other country) are of key importance to Canadian business owners. They need to know that if an American based service is used, then they could be violating privacy laws without even realizing it; though not knowing will not protect them from being fined or prosecuted if found to be in violation of PIPEDA. Following PIPEDA does not mean one cannot do business with American service providers, but it does mean that one must take responsibility of ensuring the protection of private information; usually through amendments of contracts between them and the service provider.
